New policies into effect from late March 2016

Below are new significant policies that are going to enter into force from March 21 – 31, 2016:
1. Application for registration of e-commerce service applications

From March 31, 2016, the Circular No. 59/2015/TT-BCT providing for management of electronic commerce operations via mobile applications will enter into force.

Pursuant to this Circular, the application for registration of e-commerce service applications includes:
- Application form for registration of e-commerce service applications.

- Authenticated copy of the establishment decision (in respect of organizations), business registration certificate, investment certificate or investment license (in respect of traders).

- Scheme for providing e-commerce services, including contents referred to in paragraph 3 Article 54 of the Decree No. 52/2013/ND-CP .

- Rules for management of operations of e-commerce service applications.

- Form of the service contract or cooperation agreement between traders or organizations in possession of e-commerce service applications with traders, organizations or individuals involved in buying, selling or holding auction or promotion of goods or services via such applications.

- General terms and conditions applied to transactions such as sale, purchase, auctioning or promotion of goods or services on these applications (if applicable).

2. Announcement of steel product standards

Pursuant to the Joint Circular No. 58/2015/TTLT-BCT-BKHCN , steel manufacturing or import organizations or individuals shall be held responsible for announcing standards for their own steel products as follows:

- Standards must be announced and applied in accordance with Article 3 of this Joint Circular.

- Labeling of goods must be clearly specified.

- Imported steel products must be subject to assessment of conformance to standards which are announced and applied by designated conformity-assessing organizations. 

- Dossiers of announcement of applied standards for imported steel products must be specified.

This Joint Circular will enter into force from March 21, 2016.

3. Regulations on inspection of radio frequencies

From March 25, 2016, the Circular No. 02/2016/TT-BTTTT providing for inspection of radio frequencies will enter into force. 

Pursuant to this Circular, inspection activities will include the followings:

- Inspect dossiers or documentation relating to radio frequencies and radio equipment:

+ License for use of radio frequency.

+ Authenticated copy of contract or written notification of rental or lending of radio equipment in accordance with regulations on radio operator certificates of parties that rents or lend radio equipment.      

+ Dossiers concerning use of radio equipment, inspection certificates, conformity markings attached to products, applications for granting of licenses, payment of radio frequency fees and charges and radio operator certificates.

-  Test and check radio equipment and others, including:

+ Technical parameters with reference to the license for use of radio frequency and relevant technical regulations in terms of frequency, capacity, occupied bandwidth, transmitting method, unexpected radiation, equipment installation site, antenna height and antenna installation position.   

+ Electric, electronic equipment, radio wave applicators for the purpose of determining causes of harmful interference.

Additionally, from the end of this March, other new policies will enter into force, including:

4. The Decision No. 05/2016/QD-TTg providing for management of on-loan fees and retained guarantee fees of the Ministry of Finance for the period of 2016-2020 into effect from March 25, 2016.  

5. The Decision No. 920/QD-BCT providing for application of global safeguard measures in respect of monosodium glutamate imported into Vietnam into effect from March 25, 2016.

6. The Decision No. 862/QD-BCT providing for application of interim safeguard measures in respect of steel billets and bars imported into Vietnam into effect from March 25, 2016.
