Procedure for establishing representative offices of foreign educational institutions in Vietnam

On October 31, 2024, the Minister of Education and Training of Vietnam promulgated Decision No. 3278/QD-BGDDT on the announcement of amended and annulled administrative procedures in education and training with foreign countries under the management of the Ministry of Education and Training of Vietnam.

According to the Decision, the procedure for establishing a representative office of a foreign educational institution in Vietnam is as follows:

Implementation order:

- Step 1: the foreign educational institution or organization requesting permission to establish a representative office in Vietnam sends an application to the Ministry of Education and Training of Vietnam.

- Step 2: Within 5 working days from the receipt of the adequate application as per regulation, the Ministry of Education and Training of Vietnam shall collect feedback from relevant agencies, units, and local authorities.

Agencies, units, and local authorities shall provide written feedback within 15 working days from the receipt of the written request. Within 5 working days from the receipt of feedback from relevant agencies, units, and local authorities, the Ministry of Education and Training of Vietnam shall issue a decision to permit the establishment of the representative office of the foreign educational institution or organization following Form No. 19 enclosed with Decree No. 124/2024/ND-CP.

In case of refusal, the receiving authority shall answer and explain in writing.

Where the application is inadequate, within 5 working days, the receiving authority shall issue a written notice in person, through postal services, or via emails to the applicant for acknowledgment and addition.

** Implementation:

In-person, through postal services, or via online public service portals.

*** Composition and quantity:

- Composition:

+ Written request for permission to establish a representative office following form No. 18 in the Appendix enclosed with Decree No. 86/2018/ND-CP;

+ Document proving the legal status of the foreign educational institution or organization;

+ Certified copies or copies enclosed with originals for comparison of the operational charter of the foreign educational institution or organization;

+ Quality accreditation certificate of the foreign educational institution or certificate of educational quality recognition of a competent authority;

+ Summarized report on the establishment and development of the foreign educational institution or organization;

+ Draft operational and organizational regulations of the representative office of the foreign educational institution in Vietnam;

+ written introduction of the Head of the representative office of the foreign educational institution in Vietnam and his/her background.

+ Written confirmation issued by a foreign authority shall undergo consular legalization at the Ministry of Foreign Affairs of Vietnam or a diplomatic representative mission, consulate, or authorized authority carrying out consular functions of Vietnam abroad unless otherwise prescribed by international treaties to which the Socialist Republic of Vietnam is a signatory.

- Quantity: 1 application.
