According to Article 6 of the Regulation on the Management and Use of Apartment Buildings enclosed with Circular No. 05/2024/TT-BXD internal regulations on the management and use of apartment buildings are as follows:
- Apartment buildings within the application scope of the Regulation enclosed with Circular No. 05/2024/TT-BXD shall have internal regulations on the management and use of apartment buildings with contents prescribed in Clause 2 Article 6 of the Regulation enclosed with Circular No. 05/2024/TT-BXD .
- Internal regulations on the management and use of apartment buildings shall contain the following contents:
+ Regulations applicable to owners, users, temporary residents, and customers entering and exiting the apartment buildings;
+ Prohibited contents during the management, operation, and use of apartment buildings; regulations on assurance of environmental hygiene, behavioral culture, and security and order in apartment buildings;
+ Regulations on the use of common property of apartment buildings;
+ Regulations on repair of damage, change of equipment in private property, and handling measures upon incidents in apartment buildings;
+ Regulations on fire and explosion prevention and control in apartment buildings;
+ Regulations on the disclosure of information relevant to the use of apartment buildings;
+ Regulations on obligations of owners and users of apartment buildings, containing the contributions for funding for the maintenance and operation of apartment buildings as per regulation and handling measures in case of failure to fulfill such obligations;
+ Other regulations depending on the characteristics of each apartment building.
- Where the first apartment building meeting has not been held, the investor shall develop the internal regulation on the management and use of apartment buildings following Clause 2 Article 6 of the Regulation enclosed with Circular No. 05/2024/TT-BXD attached with apartment trading or lease-purchase contracts and disclose the internal regulation at the community area, elevator lobby, and reception area of the apartment building.
- When organizing the first apartment building meeting, the meeting may consider revising or supplementing the internal regulation on the management and use of apartment buildings formulated by the investor. Revised and supplemented contents shall contravene housing laws and the Regulation enclosed with Circular No. 05/2024/TT-BXD .
After the first apartment building meeting, the Management Board or managerial representative of the apartment building, in case of not establishing a Management Board, shall disclose the internal regulation at the community house, elevator lobby, and reception area of the apartment building.
