Vietnam’s 4 new administrative procedures in science and technology

On February 22, 2024, the Minister of Science and Technology of Vietnam promulgated Decision No. 156/QD-BKHCN on the disclosure of new administrative procedures in science and technology under the management of the Ministry of Science and Technology of Vietnam.

According to the Decision, 4 new administrative procedures in science and technology under the management of the Ministry of Science and Technology of Vietnam are as follows:

- Central-level administrative procedures:

+ Procedure for determining whether or not investment projects use obsolete technology, pose risks of environmental pollution, or are natural resource-intensive.

+ Procedure designating or re-designating organizations inspecting machinery, equipment, and technological lines in investment projects.

+ Procedure for additional scope of inspection of machinery, equipment, and technological lines in investment projects.

- Provincial-level administrative procedure: procedure for determining whether or not investment projects use obsolete technology, pose risks of environmental pollution, or are natural resource-intensive.

- The investor shall formulate an application for the determination of technologies and send it in person or through postal services to the Single-Window Department of the Ministry of Science and Technology of Vietnam or conduct an online submission through the system of information on administrative procedure settlement of the Ministry of Science and Technology of Vietnam.

- If the application is inadequate or invalid as per regulation, the Single-Window Department shall immediately return the application to the investor and specify documents requiring amendments for the investor to complete the application in case of in-person submission at the Single-Window Department.  

If the investor submits the application online or through postal services, the Ministry of Science and Technology of Vietnam shall request the investor to amend and complete the application in writing within 2 working days from the date on which the application is received.

- Within 3 working days from the date on which the adequate and valid application is received, the Ministry of Science and Technology of Vietnam shall send documents to the Ministry of Natural Resources and Environment of Vietnam and relevant ministries to collect suggestions.  

In case of necessity, the Ministry of Science and Technology of Vietnam shall collect suggestions on specialized issues and determination of technologies of the investment project from independent organizations and specialists.

- Within 15 working days, authorities subject to suggestion collection and independent organizations and specialists shall send written suggestions to the Ministry of Science and Technology of Vietnam.

- Regarding a large-scale project with complex technologies, where necessary, the Ministry of Science and Technology of Vietnam shall, within 20 working days from the date on which the adequate and valid application is received, establish a Science and Technology Advisory Council and undertake an on-site visit for further determination of the technologies of the investment project.

- Within 5 working days from the date on which suggestions from relevant authorities, the Science and Technology Advisory Council, and independent organizations and specialists are received, the Ministry of Science and Technology of Vietnam shall send a written determination on the project's technologies to the investor.
