This Decree prescribes 5 types of land prohibited for construction of golf courses and other facilities supporting gold course business activities, including:
- Land used for national defense and security purposes;
- Forest land or rice paddy cultivation land, unless otherwise prescribed in clause 2 and 3 of Article 6 in the Decree No. 52;
- Land located within areas having original elements creating ranked historical-cultural relics and landscapes, or relics that are on the inventory list compiled by the provincial People's Committees, except for the cases specified in Clause 4 of Article 6 in the Decree No. 52;
- Land intended for development of industrial zones, industrial complexes, concentrated information technology parks and hi-tech zones;
- Land located within the safety corridors of water resource structures (e.g. dykes or embankments) and beaches in accordance with regulations in force.
In addition, the Decree prescribes the standard golf courses having 18 holes are not allowed to cover more than 90 ha (not more than 5 ha/hole on average) and must be completely built within the maximum duration of 36 months of receipt of land rental decisions.
Decree No. 52/2020/ND-CP is taking effect on June 15, 2020.
