Application and documentation requirements for affected people’s entitlement to support given according to Resolution No.42

The Prime Minister has just promulgated the Decision No. 15/2020, regulating the implementation of policies on support for COVID-19-stricken people.

This Decision specifies application and documentation requirements for entitlement to direct payments given groups of people afflicted with the Covid-19 disease according to the Resolution No. 42/NQ-CP dated April 9, 2020.

For instance, employees whose employment contracts are temporarily suspended or who take unpaid leave will be entitled to financial support if they meet the following requirements:

- The length of time during which their employment contracts are temporarily suspended or they take unpaid leave within their contract term must be at least 1 consecutive month from April 1, 2020 to end of June 30, 2020; and

The date starting the temporary suspension of their employment contracts or their unpaid leave must fall between April 1, 2020 and June 1, 2020.

- They are participating in the compulsory social insurance plan till the date before the temporary suspension of their employment contracts or their unpaid leave.

- They are working for enterprises generating no revenue or no longer having funds for payment of their wages (after these enterprises have already used up wage reserve funds, after-tax profit and other legitimate financing sources with balance calculated till March 31, 2020) due to the Covid-19 disease's impacts.

Application procedures will be as follows:

- Affected enterprises compile the list of employees subject to temporary suspension of employment contracts or compulsory unpaid leave that meet the aforesaid requirements, and request grassroots-level trade unions (if any) and social security authorities to attest to the list (within 03 working days).

- Affected enterprises send application documentation (according to the Appendix to this Decision) to People’s Committees at the districts where their offices are located.
