1. Abrogation of certain regulations on tobacco trading
This notable content is introduced in the Government’s Decree No. 17/2020/ND-CP on amendments to Decrees prescribing business conditions in the fields under the management of the Ministry of Industry and Trade.
According to this Decree, the following regulations on eligibility requirements to be satisfied when applying for a license to manufacture tobacco products have been abrogated:
- The requirement regarding technical regulations/standards for tobacco products.
- The requirement regarding brand ownership.
- The requirements regarding environmental protection, fire and explosion prevention and control.
The Decree No.17/2020/ND-CP is coming into force from March 22, 2020.
2. Violations committed during enforcement of Law on penalties for administrative violations
On February 12, 2020, the Government has promulgated the Decree No. 19/2020/ND-CP prescribing inspection and disciplinary actions against violations committed during enforcement of the Law on penalties for administrative violations.
According to this Decree, officials and public employees who commit any of the violations in Article 22 of this Article during their enforcement of the Law on penalties for administrative violations shall, depending on the severity of the violation, shall be disciplined. The following are some violations:
- Keeping documents on violations suspected of crimes for imposing administrative penalties.
- Abusing positions or authority vested to harass, ask for and receive money and/or property of the violating entities; tolerating, screening or limiting legitimate rights of the violating entities in the course of handling administrative violations.
- Failing to handle administrative violations; failing to impose remedial measures or administrative penalties on violating entities according to law regulations….
The Government’s Decree No. 19/2020/ND-CP is coming into force from March 31, 2020. Particularly, regulations in Chapter IV on disciplinary actions against violations committed during enforcement of the Law on penalties for administrative violations are coming into force from July 01, 2020.
3. Work space for professors, associate professors, senior lecturers and lecturers
This content is introduced in the Circular No. 03/2020/TT-BGDDT providing detailed guidance on standards and norms for using areas of buildings in education and training sector.
According to this Circular, work space for professors, associate professors, senior lecturers and lecturers are provided for as follows:
- Minimum work space per each professor: 18m2;
- Minimum work space per each associate professor: 15m2;
- Work space for senior lecturers and lecturers: at least 10m2/person.
A building with 20 classrooms must have 01 waiting room for lecturers which has a minimum area of 24m2 and provides a minimum space of 3m2 per person.
Note: These regulations apply to universities, institutions, colleges and scientific research institutes licensed to provide doctoral programs, pedagogy colleges and pedagogy post-secondary training schools in the national education system.
The Circular No. 03/2020/TT-BGDDT is coming into force from March 27, 2020.
4. Promulgation of 05 national technical regulations in transport sector
05 national technical regulations are enclosed with the Circular No. 27/2019/TT-BGTVT including:
- QCVN 101:2018/BGTVT - National technical regulation on building, repairing yards for sea-going ships.
- QCVN 67:2018/BGTVT - National technical regulation on pressure vessels of means of transportation and offshore installations.
- QCVN 22:2018/BGTVT - National technical regulation for the construction and survey of lifting appliances.
- QCVN 102:2018/BGTVT - National technical regulation on safe work of boiler on offshore installation.
- Amendment No. 3:2018 of QCVN 21:2015/BGTVT - National technical regulation on classification and construction of sea-going steel ships – Amendment No. 3:2019.
The Circular No. 27/2019/TT-BGTVT is coming into force from March 31, 2020.
