Issues arising from foreign employee’s HI contributions are now addressed

Social Insurance of HCMC has recently issued the Official Dispatch No. 288/BHXH-QLT on HI contribution by foreign employees.

Based on the Official Dispatch No. 389/BYT-BH dated January 31, 2020 of the Ministry of Health, giving responses to queries arising from foreign employee’s HI contribution, by this document, Social Insurance of HCMC provides instructions about foreign employee's implementation of HI as follows:

If foreign employees have been recruited at least 12 months before coming to Vietnam to work as intracompany transferees as provided in clause 1 of Article 3 in the Decree No. 11/2016/ND-CP including managers, managing directors, experts and technical staff members of a foreign enterprise already establishing its commercial presences within the territory of Vietnam, or as temporary intracompany transferees to a foreign enterprise’s commercial presences within the territory of Vietnam, they will be exempted from the HI contribution requirement.

Reduction in HI participation period is allowed from February 1, 2020. If HI participants holding HI cards incur medical costs in February 2020, their HI participation periods will be reduced, starting to be counted from March 1, 2020.

Social Insurance of HCMC requests its affiliated units to imperatively review and prepare documentation on any possible adjustment in HI participation period for foreign employees covered by the aforesaid regulations, and send such documentation to relevant Social Insurance agencies before March 31, 2020.

The Official Dispatch No. 288/BHXH-QLT is introduced on February 18, 2020.
