UAV owners need registration with regulatory authorities

Recently, the Prime Minister has promulgated the Directive No. 02/CT-TTg on strengthening of measures to manage and supervise operations of unmanned aerial vehicles (UAV) and ultralight aircraft

With a view to strictly controlling UAVs and ultralight aircraft in order to protect national defence, social security and order in the upcoming time, the Prime Minister is ordering:

- Ministry of Public Security to cooperate with Ministry of Industry and Trade, and Ministry of National Defense, in inspecting, reviewing and requesting persons and entities owning UAVs and ultralight aircraft to make registration for these equipment; 

- Ministry of Industry and Trade to cooperate with Ministry of National Defense and Ministry of Public Security in fortifying measures to manage import, temporary import and re-export of UAVs and ultralight aircraft;

- Ministry of Transport to cooperate with ministries and sectors in researching on any amendment to legislative documents about management of UAVs and ultralight aircraft in the system of legislative documents on civil aviation; etc.

Certificates of proof of service by bailiff are unable to replace notarized and authenticated documents

This is the highlight of the Decree No. 08/2020/ND-CP on organization and operation of bailiff offices.

This Decree defines legal value of each certificate of proof of service by bailiff as follows:

- A certificate of proof of service by bailiff cannot replace notarized, authenticated or other administrative documents.

- Certificate of proof of service by bailiff is a source of evidence that the Court may consider when trying civil and administrative cases in accordance with laws; is a basis for transactions between entities and persons as per laws.

During the process of evaluation and consideration of the probative value of evidence, where necessary, People’s Courts and People’s Procuracies may call bailiffs, other entities or persons to appear in court hearings to clarify authenticity of a certificate of proof of service by bailiff. 

In that situation, they must be present at the court.

The Decree No. 08/2020/ND-CP is entering into force on February 24, 2020.
