From January 1 this year, fine of up to 1 million dong is imposed for the act of passing through amber traffic light

This is the highlight of the Decree No. 100/2019/ND-CP prescribing administrative penalties for violations arising from road and rail traffic activities.

Point e of clause 4 of Article 6 in this Decree prescribes that persons riding motorcycles or moped (including electric bikes) who contravene traffic lights are fined from 600,000 dong to 1,000,000 dong.

(In the existing regulations set forth in point c of clause 4 of Article 6 in the Decree No. 46/2016/ND-CP the rate of fine for the same act ranges from 300,000 dong to 400,000 dong).

Article 10. Road signal system (sourced from the 2008 Law on Road Traffic)


3. The traffic light signals are in three colors, each having the following meaning:

a) A green light means proceed;

b) A red light means stop;

c) An amber light means stop behind the stop line, except for road users who have passed the stop line and may keep moving on; in case of a flashing amber light signal, road users may proceed but shall slow down and give way to pedestrians.

Also, drivers of motor vehicles and the like going through red or amber traffic lights will be fined from 3,000,000 dong to 5,000,000 dong under the provisions of point a of clause 5 of Article 5 in the Decree No. 100.

 (Existing regulations prescribe that the rate of fine ranges from 1,200,000 dong to 2,000,000 dong as stipulated in point a of clause 5 of Article 5 in the Decree No. 46).
 

“Decree No. 100/2019 has imposed stricter fines (by setting out new penalty regulations and determining higher fines) that are able to deter from acts of drunk driving and will contribute to limiting the number of traffic crashes involving drinking and driving. Communications agencies need to disseminate these regulations to the public so that they are aware and observe them to enhance traffic safety as well as protect themselves and others", Mr. Bui Tuong Vu, Legal Advocate and Director of THƯ VIỆN PHÁP LUẬT Co., stressed.
