The Decree prescribes that persons riding motorcycles, mopeds (including electric bikes) and the like on the road with blood or breath alcohol content will be subject to the following fines:
- Those who are tested for blood or breath alcohol content not exceeding 50 mg/100 ml of blood or 0.25 mg/1 l of breath will be fined from 2,000,000 dong to 3,000,000 dong (Meanwhile, Decree No. 46/2016/ND-CP does not regulate any fine in this case).
- Those who are tested with blood or breath alcohol content exceeding between 50 mg and 80 mg/100 ml of blood, or exceeding between 0.25 mg and 0.4 mg/ 1 l of breath will be fined from 4,000,000 dong to 5,000,000 dong (Meanwhile, the rates of fine imposed under the Decree No. 46 range from 1,000,000 dong to 2,000,000 dong).
- Those who are tested with blood or breath alcohol content exceeding 80 mg/100 ml of blood, or exceeding 0.4 mg/ 1 l of breath will be fined from 6,000,000 dong to 8,000,000 dong (Meanwhile, the rates of fine imposed under the Decree No. 46 range from 3,000,000 dong to 4,000,000 dong).
Decree No. 100/2019/ND-CP is entering into force on January 1, 2020.
