Notable policies coming into force from the middle of October, 2019

There are many policies which are coming into force from October 11 – 20, 2019. The following are the most notable ones:

1. 04 rules for use of food additives

This content is introduced in the Circular No. 24/2019/TT-BYT promulgated on August 30, 2019 prescribing management and use of food additives.

According to this Circular, the use of food additives must comply with the following 04 rules:

-  The use of a particular food additive must ensure that:

+ It must be a type of food additives permitted for use in foods and shall be used only in such foods where it is permitted for use;    

 + The amount used does not exceed the maximum level permitted for use in a type or group of foods;

+ The actual amount used must be the lowest possible level needed to get the desired technological effect in a particular food product.

- The use of food additives is justified only if they are necessary to achieve the desired effect in food products but they must be safe and cause no adverse effect on the human health, do not deceive or mislead consumers, and fulfill one or certain functions of food additives only.

- Food additives must meet technical and food safety requirements set forth in relevant legislative documents;

- Besides being added to food products in the manufacturing process, food additives may also appear in foods when they have been already contained in the raw materials or ingredients used for manufacturing such foods. Such cases must comply with regulations in Article 9 of this Circular.

The list of food additives permitted for use in foods is available in the Circular No. 24/2019/TT-BYT which is coming into force from October 16, 2019.

2. 03 cases where applicants for issuance/change of citizen identity card are exempted from fee payment

This content is provided for in the Circular No. 59/2019/TT-BTC on fees for processing of applications for citizen identity card, collection, transfer and management thereof, which is coming into force from October 16, 2019.

According to this Circular, an applicant for issuance or change of citizen identity card is exempted from payment of fee in the following cases:

-  An application for change of citizen identity card is submitted due to changes in administrative divisions decided by the Government;

-  An application for re-issuance/change of citizen identity card is submitted by father, mother, spouse or a child under the age of 18 of a martyr, wounded soldier or person enjoying same benefits as a wounded soldier, a child under the age of 18 of a wounded soldier or person enjoying same benefits as a wounded soldier, sick soldier or a citizen permanently residing in a border commune, etc.; or

- An application for re-issuance/change of citizen identity card is submitted by a double orphan under the age of 18.

3. 12 cases of compulsory reduction of vehicle speeds from October 15, 2019

The Circular No. 31/2019/TT-BGTVT prescribing speeds and safe distances of motor vehicles and heavy-duty vehicles in road traffic has been promulgated on August 29, 2019.

According to this Circular, when participating in road traffic, a vehicle operator is required to slow down to stop safely in 12 cases prescribed in Article 5 of this Circular, including:

- There is a warning sign or obstacle appearing on the road;

- He/she makes a turn or has a limited visibility; 

- He/she arrives at an intersection with another road or railway, or on a curved road, a road with hairpin turns, a sloping or mountain road, or a narrow or rough road;  

- He/she drives through a narrow bridge or culvert, spillway or tunnel, or prepares to reach the top of a slope or descends it;

- He/she goes through an area where a school, hospital, bus station or crowded public construction is located, an area with large population or where factories or office buildings are located along the road, road construction site or traffic accident scene, etc.

The Circular No. 31/2019/TT-BGTVT is coming into force from October 15, 2019.

4. 06 measures for dealing with credit risks of small and medium-sized enterprises (SMEs)

This content is introduced in the Circular No. 57/2019/TT-BTC on mechanism for dealing with risks of credit guarantee funds for small and medium-sized enterprises.

According to this Circular, SMEs that face credit risks as regulated shall implement the following measures for managing such risks:

- Debt restructuring:

+ Adjustment of debt payment terms;

+ Debt rescheduling.

- Debt freezing.

- Handling collaterals.

- Selling debts.

- Writing off debt interests.

- Writing off debt principals.

Further details about such credit risk management measures are available in the Circular No. 57/2019/TT-BTC (which is coming into force from October 15, 2019).
