1. Increase of monthly benefits for retired commune-level officials from July 01, 2019
This notable regulation is introduced in the Circular No. 09/2019/TT-BNV providing guidelines for adjustment of monthly benefits for retired commune-level officials who are old and weak.
According to this Circular, monthly benefits enjoyed by retired commune-level officials who are old and weak from July 01, 2019 are as follows:
- Monthly benefit of an official who is formerly a Party Committee Secretary or Chairperson of the Commune-level People’s Committee: VND 1.974.000/month x 1,0719 = VND 2.116.000/month (VND 142.000/month increase compared with the current one).
- Monthly benefit of an official who is formerly a Deputy Secretary of the Party Committee, Deputy Chairperson, Standing Member of the Party Committee, Secretarial Commissioner of the Commune-level People’s Committee, Secretary of the Commune-level People’s Council, head of communal detachment or head of Commune-level Police Office: VND 1.910.000/month x 1,0719 = VND 2.048.000/month (VND 138.000/month increase compared with the current one).
- Monthly benefit of an official who is formerly holder of another title: VND 1.768.000/month x 1,0719 = VND 1.896.000/month (VND 128.000/month increase compared with the current one).
These new monthly benefits increase by 7,19% compared with those received in June, 2019.
2. Payment of costs of medical services directly to health insurance cardholders even if they have lost their cards
This notable regulation is introduced in the Circular No. 09/2019/TT-BYT on evaluation of health facilities’ eligibility for conclusion of covered primary medical service contracts and direct payment of costs of covered medical services.
According to this Circular, costs of covered medical services shall be reimbursed directly to patients having health insurance card in the following cases:
- A patient uses medical services at a health facility that does not enter into a covered primary medical service contract;
- A patient uses medical services inconsistently with regulations in Article 28 of the Law on health insurance in 2008;
- A patient does not present his/her health insurance card before hospital discharge, is transferred to another health facility within a day due to medical emergency, becomes unconscious or dies or has lost his/her health insurance card without having it reissued yet;
- Health insurance card data is not provided or is provided inaccurately;
- A patient has participated in the health insurance plan for at least 5 consecutive years, has paid a co-payment amount greater than 6 months' statutory pay rate in the year (except self-referrals to other out-of-network healthcare establishments) and has not received the refund of the amount in excess to 6 months' statutory pay rate.
3. New regulations on penalties for violations committed by hotels and guesthouses
The Decree No. 45/2019/ND-CP prescribing administrative penalties for violations arising in the tourism sector has issued a lot of regulations on imposition of the minimum penalties for violations against the requirements for technical facilities and tourist accommodation services as follows:
- A fine ranging from VND 1,000,000 to VND 3,000,000 shall be imposed for one of the following violations:
+ Do not provide beds, mattresses, mats, blankets or pillows meeting regulations in force;
+ Do not have face towels or bath towels meeting regulatory requirements;
+ Do not change bedcovers, mats or blanket covers or pillow covers before new visitor’s check-in;
+ Do not change face towels or bathing cloths before new visitors arrive.
- A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for failing to have toilets meeting regulatory requirements (the hotel or guesthouse’s operation shall also be suspended for 01 – 03 months if it commits this violation).
The aforesaid penalties will be applied to violating individuals while organizations committing the same violations will be subject to the penalties which are 02 times more than as those for violating individuals.
4. Fine up to VND 25 million for playing violently in sport events
This important regulation is introduced in the Decree No. 46/2019/ND-CP prescribing administrative penalties for violations arising in the sports sector. According to this Decree,
- A fine ranging from VND 20,000,000 to VND 25,000,000 shall be imposed on persons for intentionally causing injuries for other players, playing violently during both training and competitions.
In addition to the fine, the violating person shall be suspended from participation in any sports competition for a period ranging from 03 to 06 months.
- A fine ranging from VND 15,000,000 to VND 20,000,000 shall be imposed on persons for committing the following violations when participating in sport events:
+ Scolding, slandering and insulting dignity and honor (public apologies must be expressed as punishment for these acts);
+ Threatening to insult health and life;
+ Having reactions in breach of moral standards, customs and traditional values of Vietnam.
