Latest documentation requirements for childbearing female workers’ entitlement to maternity insurance benefits are now available

THƯ VIỆN PHÁP LUẬT would like to keep you informed of documentation requirements for entitlement to maternity insurance benefits with regard to eligible childbearing female workers which have recently been issued in the Decision No. 777/QD-BHXH dated June 24, 2019.

1. With regard to SI contribution payers:

Within the maximum duration of 45 days from the date of resumption of work, the following documents must be submitted to employers:

-  Duplicate copy of the Birth Certificate or Extract of the Birth Certificate or duplicate copy of the Notice of Birth of the child. 

- If the child is dead after birth, the following documents must be submitted:

+ Duplicate copy of the Birth Certificate, extract of the Birth Certificate or the duplicate copy of the Notice of Birth of the child, the duplicate copy of the Death Certificate or the extract of the Death Certificate or the duplicate copy of the Notice of Death of the child;

+ In case the child is dead after birth, but the Notice of Birth has not yet been issued, the certified extract or the summary of medical record or the Notice of Hospital Discharge of the mother showing her child's death must be submitted.  

- In case the mother is dead after birth, the duplicate copy of the Notice of Death or the extract of the Death Certificate is required.

 - In case a mother giving birth to a child is incapacitated to take care of her child, the original copy of Medical Assessment Report of the mother must be added.

- In case it is necessary for a pregnant female worker to take leave for antenatal care as provided in clause 3 of Article 31 in the Law on Social Insurance, the following additional documents must be included:

 + In case of inpatient treatment, the duplicate copy of the Notice of Hospital Discharge or the summary of the medical record showing antenatal care must be provided.

+ In case of outpatient treatment, the original copy of the Certificate of Leave paid by social insurance coverage that shows antenatal care must be submitted.

+ In case it is mandatory to make medical assessment, the original copy of the Medical Assessment Report must be submitted.

Employers send the list of employees entitled to maternity insurance coverage within 10 days of receipt of all required documents from employees and social insurance agencies will proceed to make decision on payment of social insurance coverage within the maximum period of 6 working days of receipt of all required documents from employers.

2. With respect to cases in which maternity insurance coverage is paid during the permitted interval between periods of payment of SI contributions due to dismissal, military demobilization or discharge prior to the labour date:

Showing SI booklets to SI agencies of provinces/districts of their residence together with documents the same as SI contribution payers mentioned above and providing the following additional documents: 

- Certificate of leave for antenatal care with respect to the case in which a pregnant female worker is on leave for antenatal care.

- Original copy of invoices or documents evidencing payment of medical assessment costs; list of medical assessment items in the case of payment of medical assessment costs. 

 (this regulation is applied to the case in which a female worker gives birth to a child during the period of payment of SI contributions from January 1, 2018 onwards, but has no longer worked for an employer and submits application for insurance coverage at social insurance agencies).

Social insurance agencies will make decision on grant of insurance coverage within the maximum duration of 3 working days of receipt of all required documents from employees.

Notes: Employers or employees may have the option of the following methods for submission of documents and receipt of decisions as follows:

- Electronic transactions;

- Public postal services;

- Submitting documents and receiving decisions in person at social insurance agencies.

Decision No. 777/QD-BHXH will enter into force from the signature date.
