The Decree supplements regulations on prices subject to registration fees that apply to the cases in which the one-off payment of land rents with respect to the renting of state land is made. Followings are the specific regulations:
If the renting period is less than the period of use of land classified by types as defined in the Land Price Chart, the price of land within the renting period on which the registration fee is charged will be determined according to the following formula:
Land price within the land renting period on which the registration fee is charged = Land price specified in the Land Price Chart/70 years X the land renting period
Also, documentation requirements for declaration of the registration fee applied to specific land plots will include original and duplicate copies of the following documents:
- Original copy of the registration fee declaration form completed by using the given form;
- Valid duplicate copies of written documents evidencing real property (or real property owner) obtaining registration fee exemptions (if any), except cases in which original copies have already been submitted in accordance with regulations in force;
- Valid duplicate copies of written documents evidencing the legitimate origins of real property including legal documents on transfer of property under agreements signed by transferors and transferees.
The Decree No. 20/2019/ND-CP will take effect on April 10, 2019.
