THE ANNOUNCEMENT OF NEWLY ISSUED ADMINISTRATIVE PROCEDURES IN THE FIELD OF
SOCIAL PROTECTION UNDER THE STATE MANAGEMENT FUNCTION OF THE MINISTRY OF LABOR,
INVALIDS AND SOCIAL AFFAIRS

Pursuant to Decree No.
62/2022/ND-CP dated September 12, 2022 of the Government on the functions,
duties, powers, and organizational structure of the Ministry of Labor, Invalids
and Social Affairs;
Pursuant to Decree No.
63/2010/ND-CP dated June 8, 2010 of the Government on control of administrative
procedures; Decree No. 48/2013/ND-CP dated May 14, 2013, and Decree No.
92/2017/ND-CP dated August 7, 2017 of the Government on amendments to Decrees
related to administrative procedure control; and Decree No. 92/2017/ND-CP dated
August 7, 2017 on amendments to certain provisions of the Decrees related to
administrative procedure control;
Pursuant to Decree No.
110/2024/ND-CP dated August 30, 2024 of the Government on social work;
Pursuant to Circular No.
02/2017/TT-VPCP dated October 31, 2017 of the Minister, Chairperson of the
Government Office on guidance on administrative procedure control;

Article 1. Announce, as
attached to this Decision, the newly issued administrative procedures in the
field of social protection under the state management function of the Ministry
of Labor, Invalids and Social Affairs.
Article 2. This Decree comes
into force as of October 15, 2024.
Article 3. The Chief of the
Ministry’s Office, Director of the Legal Department, Director of the Department
of Social Protection, and Heads of relevant units shall implement this
Decision./.

PART II. DETAILED
CONTENTS OF EACH ADMINISTRATIVE PROCEDURE
1. Name
of procedure: Issuance of confirmation of social work practice experience
Procedure steps:
- Step 1. The practitioner must
submit a request for practice (using Form No. 03 provided in the Appendix
issued with Decree No. 110/2024/ND-CP) along with copies and present the
original of relevant professional diplomas, certificates, or credentials (if
any) to the social work service provider where the practice is registered;
- The head of the social work
service provider is responsible for accepting the practitioner within three
(03) working days from the date of receiving the application. If the
practitioner is not accepted, the head must provide a written response clearly
stating the reasons within one (01) working day.
- Step 3. The head of the service
provider issues a decision assigning a practice supervisor (using Form No. 04
provided in the Appendix issued with Decree No. 110/2024/ND-CP). The duration
of practice is as follows: 12 months for those with a bachelor’s degree or
higher; 9 months for those with a college degree; 6 months for those with an
intermediate-level degree. The practice must be conducted at the social work
service provider.
- Step 4. Within two (02) working
days from the end of the practice period, the practice supervisor must provide
written feedback on the practitioner’s performance, including their competency,
expertise, practice skills, and adherence to the ethical standards of the
social work profession. The supervisor also recommends the issuance of the
confirmation of social work practice experience to the head of the social work
service provider. The supervisor is held accountable if the practitioner causes
professional errors during the practice that affect the health or rights of
beneficiaries due to the supervisor's negligence.

Applications can be submitted in
person to the social work service provider or via public postal services.
1.3. Composition and number of
applications:
1.3.1. Application components:
- Request for practice form (using
Form No. 03 provided in the Appendix issued with Decree No. 110/2024/ND-CP);
- Relevant diplomas, certificates,
or credentials (if any) (submit a copy and present the original for verification).
1.3.2. Number of applications: One
(1) set.

days

- The duration of practice is as
follows: 12 months for those with a bachelor’s degree or higher; 9 months for
those with a college degree; 6 months for those with an intermediate-level
degree;
- Practice supervisors must meet
the following conditions: Have a professional scope consistent with the content
and field of social work practice; have at least three years of experience
working at a social work service provider; hold an educational level equivalent
to or higher than the practitioner.
- Each supervisor may guide a
maximum of five (5) practitioners at the same time.
1.11. Legal basis for issuance:
Decree No. 110/2024/ND-CP dated

2. Name
of procedure: (New) issuance of a social work practice registration
certificate
2.1. Procedure steps:
- Step 1. The applicant submits one
(01) set of application documents (in person or online) as prescribed to the
Department of Labor, Invalids, and Social Affairs (in the locality where the
social work service provider, training institution, vocational education
institution is located, where the social work registrant is employed or where
an independent social worker practices).
- Step 2. Within seven (07) working
days from the date of receiving a complete application as prescribed, the
Department of Labor, Invalids, and Social Affairs issues the social work
practice registration certificate (using Form No. 06 provided in the Appendix
of Decree No. 110/2024/ND-CP). If the application is invalid, the department
must respond in writing within three (03) working days, stating the reasons for
rejection.

2.2. Method of submission:
Applications can be submitted in
person, online, or via public postal services.

2.3.1. Application components:
- Social work practice registration
form (Form No. 07 provided in the Appendix issued with Decree No.
110/2024/ND-CP);
- Certificate of completion of
social work practice;
- Copies of diplomas, certificates,
or credentials in social work, sociology, psychology, special education, or
other social sciences as regulated by law;
- A health certificate issued by a
competent health authority within 12 months before the date of application
submission;
- Two (02) colored photographs, size
4 cm x 6 cm, taken on a white background within six (06) months prior to the
application submission.

Seven (07) working days from the
date of receiving a complete application.

3. Name
of procedure: Reissuance of a social work practice registration certificate
3.1. Procedure steps:
- The applicant submits one (01)
set of application documents (in person or online) to the Department of Labor,
Invalids, and Social Affairs (social work practitioners must apply for the
reissuance of the certificate at least 15 working days before its expiration
date);
- Step 2. Within five (05) working
days of receiving a complete application, the Department of Labor, Invalids,
and Social Affairs must reissue the social work practice registration
certificate. If the application is invalid, the Department must respond in
writing within two (02) working days, stating the reasons for rejection.
3.2. Method of submission:

3.3. Composition and number of

3.3.1. Application components:
- Application form for the
reissuance of the social work practice registration certificate (Form No. 08
provided in the Appendix of Decree No. 110/2024/ND-CP);
- The original social work practice
registration certificate (in cases of damage, information changes, or errors);
- Copies of diplomas, certificates,
or credentials relevant to the revised practice information, as specified in
Clause 3(b), Article 38 of Decree No. 110/2024/ND-CP;
- Two (02) colored photographs,
size 4 cm x 6 cm, taken on a white background within six (06) months before the
application submission;
- Certificate of social work
knowledge updating, equivalent to 120 hours of study within the last five (05)
years, for certificates that have expired.
3.3.2. Number of applications: One
(1) set.

3.10.1. The social work practice
registration certificate is reissued in one of the following cases:
- The certificate is lost or
damaged.
- Changes or corrections to
information as specified in Points a, b, and c of Clause 3, Article 38 of
Decree No. 110/2024/ND-CP, including: (i) Full name, date of birth,
nationality; personal identification number, ID card number, or passport
number; (ii) Scope of social work practice; (iii) Expiration date of the
certificate.
- The certificate has expired
(validity period of the social work practice registration certificate is five
(05) years).
3.10.2. The social work
practitioner must apply for reissuance at least 15 working days before the
certificate expires.
3.11. Legal basis for issuance:

4. Name
of procedure: Registration of social work practice in Vietnam for foreigners
and overseas Vietnamese
4.1. Procedure steps:

Invalids, and Social Affairs issues the social work practice registration
certificate (Form No. 06 provided in the Appendix of Decree No.
110/2024/ND-CP). If the application does not meet the conditions, a written
response explaining the reasons must be issued within three (03) working days.

one of three ways: in person, online, or via public postal services.

Foreigners and overseas Vietnamese
must hold a valid social work practice license issued by a competent foreign
authority or organization that is recognized under international agreements to
which the Socialist Republic of Vietnam is a party, or bilateral agreements
signed by Vietnam.
Exceptions: Foreigners and overseas
Vietnamese who hold a social work practice license issued by a competent
foreign authority or organization are not required to register for social work
practice in Vietnam under the following circumstances: engaging in social work
activities in Vietnam on a periodic basis, cooperating in training and social
work practice, or transferring technical expertise in social work practice.
