1. Foreign-invested pre-schools are allowed to enroll Vietnamese children under-5 years
This is a remarkable content of Decree No.86/2018/ND-CP on foreign cooperation and investment in education which comes into force from August 01, 2018.
According to the Decree, foreign-invested pre-school educational institutions and compulsory educational institutions may admit Vietnamese students to their foreign educational programs regardless of age.
(Previously Vietnamese students under 5 year olds were not allowed to enroll in foreign educational programs)
The number of Vietnamese students enrolling in foreign educational programs shall be lower than 50% of the total number of students who participate in the aforesaid program at the educational institution.
In addition, Vietnamese students who enroll on foreign educational programs must learn compulsory lessons in accordance with regulations issued by the Ministry of Education and Training.
2. New regulations on requirements applied to gas exporters and importers
Decree No.87/2018/ND-CP on gas business comes into force from August 01, 2018.
According to the Decree, every gas exporter/importer must:
- be an enterprise founded as regulated by laws;
- own wharves or enter into a contract for leasing wharves of Vietnam post system which have been permitted to be put on use for at least 5 years;
- own a gas tank or enter into a contract of gas tank lease which meets the safety regulations;
- satisfy fire safety requirements as regulated;
- own LPG bottles or enter into a contract for leasing LPG bottles eligible to be put on the market for LPG importer/exporter who trades in bottled LPG
The condition for total minimum capacity of tanks storing LPG, LNG and CNG has been removed.
3. New guidelines on medical declaration for goods
Decree No.89/2018/ND-CP on enforcement of the Law on Infectious Disease Prevention and Control regarding border health quarantine comes into force from August 10, 2018.
According to the Decree, medical declaration is required for all imported/exported goods and goods in transit, except the following cases:
- Goods in transit which are not discharged;
- Goods subject to quarantine of terrestrial animal, terrestrial animal products, aquatic animals and aquatic animal products as regulated
Medical declaration shall be made specifically for goods transported by road, rail, air and sea.
The goods’ owner must make all required declaration, take responsibility for the information provided in such declaration as regulated and is not allowed to counterfeit the medical declaration or use the counterfeit declaration.
4. Particular allowances for honor guards
This is a remarkable content of Decree No.90/2018/ND-CP on enforcement of the Law on Honor Guards which comes into force from August 10, 2018.
According to the Decree, honor guards may be given an particular allowance amount equal to 30% of the current pay rate or allowance according to their rank in addition to other allowances (if any) if they:
- perform the job of a bodyguard, protect international guests visiting or working in Vietnam, patrol or guard residence places, workplaces, key areas or specially important events;
- hold the position of leader or commander;
- not hold the post of Lieutenant-level or higher or not enjoy the pay rate equivalent to that of the Lieutenant or lower rank or allowances according to military rank
Moreover, allowances equal to 15%-25% of the military rank-based pay rate shall be applied to particular subjects.
Honor guards may be also given allowances for residence, housing supporting policy in community and public houses in accordance with provisions of the Law on People’s Public Security and other relevant documents.
