2018 Law on Allegation shortens the processing duration

This is the highlight of the 2018 Law on Allegation has recently been passed in the 5th plenary session of the XIVth National Assembly.

The Law prescribes duration of processing of allegations as follows:

- The maximum duration of processing of an allegation will be 30 days from the date of acceptance (as compared with 60 days which are prescribed in regulations currently in force and may be extended once with the number of extension days which is not more than 30 days).    

- With respect to complicated matters, the processing duration may be extended once with the number of extension days which is not more than 30 days (as compared with 90 days which are prescribed in regulations currently in force and may be extended once with the number of extension days which is not more than 60 days).    

- With respect to extremely complicated matters, the processing duration may be extended twice with the maximum number of extension days which is not more than 30 days per each.

The allegation-processing person is authorized to issue a written decision on extension of duration of processing of an allegation to the plaintiff, defendant, entities, organizations and individuals concerned. 

The 2018 Law on Allegation is set to commence on January 1, 2019.
