5.PEOPLE'S SUPREME COURT provides guidance for first-time offenders
Council of Justices of People’s Supreme Court promulgates the Resolution No. 01/2018/NQ-HDTP (comes into force from June 09, 2018) on guidelines on conditional parole of the Criminal Code 2015.
Explanation for first offence can be found in Clause 2, Article 2 of the Resolution. To be specific, a criminal offence will be considered first offence if the offender:
- Has not committed any criminal offence.
- Has committed a criminal offence but is eligible for exemption from criminal prosecution.
- Has committed a criminal offence but was sent to a reformatory school.
- Has a previous conviction which has been expunged.
First offence is one of the conditions for granting parole if the offender is sentenced to imprisonment for committing a serious crime or very serious crime or extremely serious crime.
6. More bonuses for Judges and court clerks from June 08, 2018
This is a significant policy stipulated in Circular No. 01/2018/TT-TANDTC dated April 24, 2018 on regulation on emulation and commendation of the Supreme's Court.
According to the Circular, there are additional bonuses for individuals and group of individuals that work in court, to be specific:
- The bonus for an individual does not exceed 20 % of the statutory pay rate.
- The bonus for a group of individuals does not exceed 15% of the statutory pay rate.
Other bonuses and benefits are specified in articles 68 to 75 of the Circular No. 91/2017/ND-CP dated July 31, 2017.
Circular No. 01/2018/TT-TANDTC will come into force from June 08, 2018 and replace Circular No. 04/2016/TT-TANDTC dated September 16, 2016.
7. 90% subsidies on agricultural insurance fees for individual agriculture producers
This is a significant policy stipulated in Decree No. 58/2018/ND-CP (comes into force from June 05, 2018), which is promulgated by the Government to stipulate the agricultural insurance (abbreviated as AI)
According to the Circular, the individual agriculture producers and organizations who are included in the AI supporting policy of the Government will be supported with an amount of money as follows:
- Individual agriculture producers of poor households or near-poverty households will receive up to 90% subsidy on AI fees.
- Individual agriculture producers of other households will receive up to 20 % subsidy on AI fees.
- Large scale agricultural production organizations that apply advanced technologies and processes towards clean and eco-friendly agriculture will receive up to 20% subsidy on AI fees.
The agricultural insurance will cover the following events:
- Natural disasters: storm, tornado, thunder, heavy rain, flood, landslide, hot weather, drought, cold weather, etc, that are declared or confirmed by a regulatory agency.
- Epidemics: the epidemic in animals, plants or humans that are declared or confirmed by a regulatory agency.
8. Regulation on promoting lecturers of public universities
From June 01, 2018, Circular No. 12/2018/TT-BGDDT on regulation on promoting lecturers who work at public universities will come into effect.
According to the Circular, the promotion will be prepared as follows:
Agencies and units are assigned to develop a plan and make a decision to establish a Promotion Council to promote lecturers level IIl; report this plan and decision to the Ministry of the Interior to make a decision regarding the lecturers level I.
The Promotion Council will announce the contents of promotion.
The Secretariat will summarize the list of applicants and report it to the Promotion Council to decide the list of candidates.
At least one day before the promotion date, the Secretariat must complete the preparation for the promotion date and also prepare the forms related to the promotion organization.
9. Instructions on applying for recognition of traditional jobs
Circular No. 52/2018/ND-CP (will come into force from June 01, 2018) stipulating some articles and policies on developing traditional jobs.
According to the Circular, the applications for recognition of traditional jobs must include the following documents:
- A summary of development and formation processes of traditional jobs:
- Copies of certificates and/or medals achieved in the national or international competitions and exhibitions or of certificates and/or medals of artistic works issued by the province or city (if any)
- Organizations and individuals, who are not able to participate in the competitions and exhibitions or do not have works that win awards, must submit specific descriptions of the traditional jobs.
- A copy of certificate of recognition of traditional jobs issued by the competent authority (if any)
According to the regulations, the People’s Committee of district will submit an application for recognition of traditional jobs to the People's Committee of province to approve.
Within 30 working days, the People’s Committee of Province will establish an Approval Council to select candidates that satisfy the requirements and make a decision to issue the certificate of recognition of traditional jobs.
