Trade, import and export policies coming into force from March 1, 2018

THƯ VIỆN PHÁP LUẬT would like to bring to our dearest members certain significant policies in the trade, import and export sectors which enter into force from March 1, 2018.

1. Termination of 50% top-up promotions applied to prepaid mobile subscribers

This noticeable content is provided by the Circular No. 47/2017/TT-BTTTT on the maximum promotional limit for mobile terrestrial communications services.

This Circular prescribes that total maximum value of mobile communications service promotion will be subject to the following changes:   

- With respect to prepaid mobile subscribers, it is not allowed to exceed 20% of total top-up value of mobile communications service (this means that it is reduced by 30% compared with the promotional value that is legally allowed by existing applicable regulations). 

- With respect to postpaid mobile subscribers, the promotional value which is not allowed to exceed 50% of total value of mobile communications service remains unchanged. 

This Circular also provides criteria for assessment of regular subscribers eligible to have access to reductions or promotions as follows: 

- Prepaid mobile subscribers:

+ Having used mobile services for a period of at least 1 year;

+ Having paid total subscription of at least VND 1,000,000 to their service providers from the date of registration of subscription.

- Postpaid subscribers include those changing from prepaid subscribers to postpaid ones when the promotional program for regular customers is taking place. 

2. PDF-formatted version required for legal deposit of electronic publications in the form of printed books 

This is the highlighted content of the Circular No. 42/2017/TT-BTTTT amending and supplementing certain articles of the Circular No. 23/2014/TT-BTTTT dated December 29, 2014.

This Circular prescribes that the digital format of electronic publications kept as legal deposit copies available in the form of records stored in data storage devices or submitted for legal deposit via the Internet network is subject to paragraph 1 Article 21 of the Decree No. 195/2013/ND-CP. 

- The prescribed digital format of electronic publications available in the form of printed books or calendars is PDF;

- The prescribed digital format of electronic publications available in the form of pictures, images, maps, posters, flyers or folded leaflets is “JPEG”;

- The prescribed digital format of electronic publications available in the form of audio recordings intended for replacement or illustration for books is “MP3”;

- The prescribed digital format of electronic publications available in the form of visual recordings intended for replacement or illustration for books is “MP4”.

Conversion of other formats of electronic publications to the aforesaid formats is allowed if contents of electronic publications are kept unchanged.

3. 12 papers required for quality inspection for import of 1 brand-new motor vehicle

This content is provided by the Circular No. 03/2018/TT-BGTVT providing regulations on quality, technical and environmental safety inspection of imported motor vehicles covered by the Decree No. 116/2017/ND-CP dated October 17, 2017. 

This Circular specifies the following 12 papers that importers must submit to apply for registration of inspection of 1 imported brand-new motor vehicle, including: 

- Registration form of quality, technical and environmental safety inspection of imported motor vehicle by using a given sample;  

- Pre-despatch quality check for each motor vehicle granted by foreign automotive manufacturing and assembling enterprises;  

- Imported motor vehicle information sheet by using a given sample;

And duplicated copies of the following papers:

- Certificate of type approval for imported vehicle, which is awarded by foreign competent entities or organizations;

- Type approval certificate for vehicle parts such as tyres, rear-view mirrors, headlights and screens, which is granted by competent entities or organizations;

- Valid documents showing the results of assessment of conformance to quality assurance requirements conducted by foreign automotive manufacturing and assembling enterprises, with respect to factories manufacturing vehicle types, which are issued by foreign competent entities and organizations;  

- Sales invoice;

- Manufacturer’s VIN interpretation (applicable to first type approval);  

- Manufacturer’s materials providing information about vehicle functions and technical specifications; 

- Form of declaration of imported goods in case of submission of the printed application; date (dd, mm, yyyy) of the declaration form in case of submission of the online application;

- Emission test report;

- Safety test report.
