Pursuant to this Decree, in order to run a food business, the certificate of conformity to food safety regulations is required, except in the following cases in which such certificate is not granted:
- Small-scale food production startup;
- Small-scale food business;
- Food production and business without any stable location;
- Small-scale processing;
- Ready-to-eat packaged food business;
- Food packaging instrument, packing material manufacturing and business;
- Restaurants operated inside hotels;
- Community commercial kitchens that do not apply for registration to operate in the food business sector;
- Street food business;
- Establishments which have been awarded one of the following certificates: GMP, HACCP, ISO 22000, IFS, BRC, FSSC 22000 or the like which remains valid.
The aforesaid entities are bound to comply with respective food safety requirements.
The Decree No. 15/2018/ND-CP is set to commence on February 2, 2018 as a replacement for the Decree No. 38/2012/ND-CP and will cause Chapter II of the Joint Circular No. 13/2014/TTLT-BYT-BNNPTNT-BCT dated April 9, 2014 to be repealed.
