Notable policies coming into force from February 2018 (Part 3)

THƯ VIỆN PHÁP LUẬT introduces 04 more notable policies that will come into force from the beginning of February:

9. Lottery agents entitled to up to 15% commissions

On December 15, 107, the Ministry of Finance promulgated Circular No. 138/2017/TT-BTC specifying expenses of lottery enterprises defined in Decree No. 122/2017/NĐ-CP.

According to the Circular, lottery agents will receive their commissions as follows:

- The commission will be decided by the lottery enterprise;

- The commission must not exceed 15% of revenue from lawful lotteries, inclusive of VAT and excise tax.

Circular No. 138/2017/TT-BTC comes into force from February 10, 2018.

10. Criteria for assessing thrift practice of public service agencies

On December 04, 2017, the Ministry of Finance promulgated Circular No. 129/2017/TT-BTC on criteria for assessment of thrift practice.

According to the Circular, thrift practice will be assessed on a scale from 1 to 100 with the following criteria:

- Thrift practice regarding certain regular expenditures: 70 points;

- Thrift practice regarding regular expenditures of financially autonomous public service agencies and administrative expenses of financially autonomous authorities: 30 points;

- Points lost for failure to comply with norms, standards and regulations on regular expenditures.

Circular No. 129/2017/TT-BTC comes into force from February 01, 2018.

11. Requirements for electronic transactions between State Treasury and other units

These are new requirements specified in Circular No. 133/2017/TT-BTC on electronic transactions of State Treasury.

According to the Circular, a unit that wishes to make electronic transactions with State Treasury in terms of state budget revenues and expenditures has to fulfill the following requirements:

- Have an unexpired digital certificate issued by a provider of public or dedicated digital signature authentication services;

- Have a computer connected to the Internet; have 01 email addressed registered with State Treasury, which will be used for every transaction on the public service page of State Treasury.

- Have a notice and granted approval by State Treasury; have an account given by State Treasury to log into the public service page of State Treasury.

More details can be found in Circular No. 133/2017/TT-BTC which comes into force from February 01, 2018.

12. Method for payment between provincial and central State Treasuries

On December 15, 2017, the Ministry of Finance promulgated Circular No. 131/2017/TT-BTC amending Circular No. 315/2016/TT-BTC on management and use of State Treasury accounts.

According to the Circular, if the State Treasury of a province or district opens a collection account at a commercial bank that has not participated in bilateral electronic payment transactions with State Treasury:

- At the end of the working days, the state budget revenues received by such collection account must be transferred to:

+ The checking account of State Accounting Authority at the transaction center of State Treasury;

+ The checking account of the State Treasury of the district, then the checking account of State Accounting Authority at the central State Treasury.

- The balance of collection accounts of State Treasuries of provinces and districts must be zero by the end of the day, except for revenues that are received after the time when transmission of payment documents is stopped.

Circular No. 131/2017/TT-BTC comes into force from February 01, 2018.
