THƯ VIỆN PHÁP LUẬT would like to introduce some noticeable regulations of Decrees coming into force from the beginning of October, 2017 (from October 01, 2017 to October 10, 2017):
1. People receiving Prime Minister's Certificates of Merit shall receive a reward equal to 3.5 times the statutory pay rate
This noticeable regulation is provided by Decree No. 91/2017/ND-CP on guidelines for Law on Emulation and Commendation which will come into force from October 01, 2017.
According to this Decree, rewards for certain emulation titles given to collectives and individuals shall be changed in comparison with regulations in Decree No. 42/2010/ND-CP dated April 15, 2010. To be specific:
- An individual receiving the Prime’s Minister Certificates of Merit shall obtain a reward equal to 3.5 times the statutory pay rate (currently 1.5);
- A collective receiving the “Government's Emulation Flag” titles shall obtain a reward equal to 12 times the statutory pay rate (currently 24.5)
- A collective receiving the "Emulation Flag of ministries, provinces or central unions” title shall obtain a reward equal to 8 times the statutory pay rate (currently 15.5 times)
- An author receiving the Ho Chi Minh prize or State prize for science and technology or literature and art shall obtain a certificate and a reward specified as followed:
- The reward for the “Ho Chi Minh Prize” shall be equal to 270 times the statutory pay rate;
- The reward for the “State Prize” shall be equal to 170 times the statutory pay rate;
2. Announcement of 20 types of goods and services on which monopoly is held by the State
The Decree No. 94/2017/ND-CP on goods, services and regions on which monopoly is held by the State in commercial activities will come into force from October 01, 2017.
According to this Decree, 20 types of goods and services on which monopoly is held by the State in commercial activities are announced, namely:
- Goods and services for the national defense and security;
- Production of gold bars
- Publishing of lotteries;
- Import of cigarettes and cigars (except for import for sale of goods exempted from tax);
- Printing of money and minting of coins;
- Publishing of postage stamps of the Socialist Republic of Vietnam;
- Transmission and regulation of the national electrical system
3. Regulations on people mobilized to carry out tasks of rescue
The Decree No. 83/2017/ND-CP on tasks of rescue carried out by fire prevention forces will come into force from October 04, 2017 and replace the Decision No. 44/2012/QD-TTg dated October 15, 2012.
According to this Decree, people mobilized to carry out tasks of rescue are entitled to the following benefits:
- People whose salaries are paid by the state budget shall receive full salaries, allowances for travelling, working in harmful environment and areas where regional allowances are available as prescribed by applicable regulations;
Expenditures on the abovementioned amounts shall be covered by budgets for regular operation of authorities and units.
- People whose salaries are not paid by the state budget and police officials shall receive allowances equal to their workday salary and be provided with accommodation and vehicles as prescribed in Points a and b Article 19 of Decree No. 30/2017/ND-CP dated March 21, 2017.
4. 6 cases in which new decisions on penalties for administrative violations shall be issued
The Decree No. 97/2017/ND-CP on amendments to certain articles of Decree No. 81/2013/ND-CP providing guidelines for Law on handling administrative violations will come into force from October 05, 2017.
According to this Decree, a person who has issued a decision on penalties for administrative violations shall issue the new decision if:
- There are violations of competence and procedures for handling administrative violations;
- The decision on penalties for administrative violations is issued in the cases prescribed in Points a, b, c and d Clause 1 Article 65 of Law on handling administrative violations;
- Documents on penalties or documents on application of measures for handling administrative violations are counterfeited or falsified;
- There are mistakes that change basic contents of the issued decision;
- A decision on handling complaints issued by the competent person or authority change the bases for and contents of the issued decision;
- There is a verdict or decision made by a court related to the entire or partial cancellation of the issued decision.
