In comparison with provisions laid down in the Decree 83/2010/ND-CP this Decree clearly defines cases in which guarantee measures must be registered only if requested, specifically including:
- Movable property (except aircraft or seagoing vessel) is put up as collateral;
- Property affixed to land that will be acquired in the future is put up as collateral;
- A guarantee must be offered to maintain the right of ownership in the case of purchase or sale of property affixed to land or future-acquired property affixed to land; purchase or sale of aircraft or sea-going vessels; purchase or sale of other movable property.
Additionally, the Decree No. 102 also prescribes that the term of registration of a guarantee measure will be from the registration date referred to in Article 5 of this Decree to the date of removal of registration of that guarantee measure.
