The procedure for settlement of disputes by commercial mediation is defined as follows:
- The parties negotiate the process of conciliation or choose to adhere to the principles of conciliation of a commercial mediation organization.
- If the parties do not form any agreement, the commercial mediator shall initiate the procedure that he deems fit for the issue and demands with the parties' approval.
- The process of mediation may, at the parties’ discretion, be carried out by one or various mediators.
- The commercial mediator has the right to make dispute resolution proposals at any time during the process of mediation.
- The parties negotiate the time and location for mediation; otherwise, such matters shall be left to the discretion of the commercial mediator.
Decree No. 22/2017/ND-CP shall take effect as of April 15, 2017.
