The following new and prominent regulations on accounting, banking, education, etc. shall come into force as of November 28, 2016:
1. Additional criteria for classification of tangible fixed assets
Apart from the prohibition on enterprises' depreciation of mixed-use buildings’ areas for sale or for rent, the Circular No. 147/2016/TT-BTC stipulates that:
One more classification of tangible fixed asset is added to the six defined in the Circular No. 45/2013/TT-BTC as follows:
- Fixed assets that are highly valuable structures funded by the state budget and put under economic organizations’ management and use are under class 6;
- Other fixed assets (not specified in the other 06 classes) are under class 7.
Enterprises shall review and re-classify their fixed assets accordingly.
Moreover, fixed assets under class 6 as newly defined shall not be depreciable but be logged in writing in regard to each asset's annual decreasing value. Therefore, the asset investment fund shall not be recorded as decreasing.
2. Removal of requirement for registration of card specimen with State Bank
14/10/2016 Circular No. 30/2016/TT-NHNN dated October 14, 2016 amends certain circulars on card-based payment and payment intermediary payment services. It stipulates that:
- Card issuers shall no longer be required to register card specimens with the State Bank according to Article 11 of the Circular No. 19/2016/TT-NHNN.
Card issuers shall instead inform the State Bank in writing of the specimens of their new cards prior to issuance via the form defined in the Circular No. 30.
Therefore, card issuers shall actively release products instead of awaiting the State Bank's written confirmation of card specimen registration.
- Providers and card-based payment and payment intermediary services shall have at least a call center that operates on a 24/7 basis and records calls to take in information and customers’ complaints.
3. Examination inspection
On October 13, 2016, Ministry of Education and Training promulgated the Circular No. 23/2016/TT-BGDDT on the organization and inspection of examinations. It details:
- Examination inspection; preparation, invigilation and grading; select admission, select graduation, thesis writing and assessment.
- Disciplinary action, administrative penalty or criminal prosecution of the persons inspected or associated with the commission of the following acts according to the nature and degree of their violations:
+ Resist providing information or documents or give inaccurate and misleading ones; seize or dispose of documents and exhibits in connection with the matters under inspection.
+ Oppose, obstruct, bribe, avenge or oppress the inspectors or individuals providing documents and information for inspection; hinder inspection activities.
+ Bribe or slander the inspectors.
+ Carry out no or few duties and obligations specified in a conclusion of inspection and rectification.
Circular No. 23/2016/TT-BGDDT replaces the Decision No. 41/2006/QD-BGDDT.
4. Circular No. 29/2016/TT-BTNMT on technical details for the establishment of coastal protection barriers.
5. Circular No. 01/2016/TT-UBDT on the management of the Committee for Ethnic Minority Affairs’ ministerial-level science and technology missions.
