New and prominent regulations in effect in early October 2016

Following the article on “Investment and commercial regulations in effect in early October 2016”, THƯ VIỆN PHÁP LUẬT introduces other new and prominent regulations that come into force from the 01st to 10th of 2016.

1. Special leave for servicemen

Circular No. 113/2016/TT-BQP , in effect as of October 08, 2016, defines rest and recuperation for professional servicemen, national defense workers and officials.

Apart from the annual leave, a professional servicemen, worker or official in the sector of national defense is granted a maximum amount of 10 days' special leave in the following events:

- Wedding of a biological or legally adopted child.

- Death or illness-derived or accident-caused long-term hospitalization of biological parents, parents-in-law, legitimate care giver of the person on leave, his husband or her wife; spouse; biological or legally adopted child.

- Casualty or severe damage to property due to an accident, natural disaster or dangerous epidemic.

2. Reporting of environment protection activities

Ministry of Natural resources and Environment promulgated the Circular No. 19/2016/TT-BTNMT on the reporting of environment protection activities.

A report by a Ministry or ministerial-level body on environment protection includes:

- General evaluation of sources of pollution or adverse impact on the environment, typical wastes and major environmental issues (if any) in a sector under the management of the Ministry of ministerial-level body.

- Progress and result of state management and environment protection:

+ Organizational structure of the system and resources for environment protection;

+ Promulgation of policies and laws on environment protection;

+ Fulfillment of responsibilities for state management of environment protection as per Section 3, Article 142 and other articles of the Environment Protection Law and guiding documents;

- Orientation of environment protection for the subsequent year and recommendations.

Circular No. 19/2016/TT-BTNMT comes into force as of October 10, 2016.

3. Promotion of investments into coastal forest development

Decree No. 119/2016/ND-CP , in effect as of October 10, 2016, regulates the management, protection and sustainable development of coastal forests in response to climate change.

The following activities promote private entities’ investments into the protection, development and utilization of coast forests:

- Investment in forest protection, afforestation, growing of non-timber forest trees, combination of agriculture and forestry, raising of ocean aquatic animals under canopies of coast forests.

- Investment in coast consolidation and erosion prevention, services for coast mangrove forests, development of eco-tourism.

- Organizations, individuals and households shall be given land, assigned to or leased forest to protect and develop forests as per the laws.

4. Allocation of salary in Vietnam Military-run Telecommunications Group

On August 24, 2016, the Government promulgated the Decree No. 121/2016/ND-CP on the pilot management of personnel and salary in Vietnam Military-run Telecommunications Group (referred to as Viettel) from 2016 to 2020.

The group shall allocate salary in the following manner:

- Establish the salary provision fund not exceeding 17% of the corporate fund of salary for a subsequent year.

- Regulate the payment of salary by position or title according to work performance, business efficiency and managerial persons’ and workers’ fulfillment of missions.

- The salary payment regulation shall incorporate democracy, openness and transparency. Organization(s) representing employees shall participate in formulating such regulation. This matter must be reported to the representative(s) of the owner prior to implementation.

- Advancement and payment of salary to managerial persons and workers as per the laws and corporate regulation of salary payment.

Decree No. 121/2016/ND-CP takes effect as of October 10, 2016.
